Question by Melanie C: How can I tell if my income taxes will be held by the IRS due to unpaid college loans?
Is there a possible way to see if my SSN# has a red flag against it, I wanna file my taxes but scared the IRS will hold my refund.

Hi. You will receive a notice in the mail from the U.S. Dept of “Education”. If they find your phone #, you will receive harassing calls from them. If this hasn’t happened already, you are paying child support. The DCSE is the only one that has preference over the U.S. Dept of “Education”.

As for the red flag, when you file {we all have to file to receive a refund if one is due}, the IRS sends you a notice stating that your refund was stolen {they use the word “offset” – they never say what things really are} and that they have no information. In the next sentence, they say you have to contact such and such an agency to get details.

    The IRS can withhold your STATE refund for unpaid college loans without prior notice to you. You can find out beforehand by calling this # 1.800.304.3107

    You’ll be in much bigger trouble by not filing at all though.

    I don’t think the IRS can collect on college loans. The thing they are known for is collecting for unpaid taxes, unpaid child support and things like that.

    There are really 2 ways to look at this. First is that it sounds like you owe the money anyway right? Might as well file your taxes. If you get the money, great. If not, that is great too since that will be that much less you owe them.

    Lastly, I would think the IRS would be required to tell you if there was some type of flag against you.

    Failing to file will only put you in a worse spot. Go ahead and file.
